Introduction

SMC Duty of Care...

Health and Safety Law clearly states that it's an employer's responsibility to ensure their employees work in a healthy & safe environment at all times as far as is reasonably practicable.

This 'environment' includes the road, and looking at the risks associated with driving compared to working in the office, there's no surprise that Health & Safety are focusing strongly on clamping down on the possible risks involved with driving at work.

Here are a few key points:

1999:
Health and Safety at Work Regulations (PDF) require employers to periodically assess the risks of all work related activities including driving.

2005:
The Road Safety Bill contained a number of measures aimed at reducing road deaths and serious injuries.

To Date:
On-going progression of the new Corporate Manslaughter Law is aimed at prosecuting companies involved in fatal accidents.
